Terms of Service

Welcome to ExpCarry LLC ("ExpCarry", "we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of https://expcarry.com (the "Site") and our coaching and in-game assistance services (the "Services"). By creating an account, placing an order, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, Refund Policy, Cookie Policy, and other referenced policies.

Non-affiliation notice. ExpCarry is an independent service provider. We are not affiliated with or endorsed by any game publisher. We do not directly trade, broker, or resell in-game items or currency; all in-game progress or resources are obtained through legitimate gameplay mechanics as intended by game developers/publishers, in compliance with their terms of service.

1. About Us & Contact

2. Services & Account Requirements

2.1 Nature of Services: We provide coaching and in-game assistance, including self-play and, where permitted by game rules, account-assisted play (e.g., boosting, leveling, raid completion) for supported online games. See our Services page for details.

2.2 Minimum Age: You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. If you are 13–17 (or under 16 in the EEA/UK for information society services), you may use the Services only with verifiable parental consent and under their supervision. We may request proof of consent (e.g., via email to [email protected]).

2.3 Accounts & Security:

  • You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.
  • Notify us immediately at [email protected] of any unauthorized use or security breach.
  • Use strong passwords and enable two-factor authentication (2FA) where available.

2.4 Game Accounts: For Services requiring temporary access to your game account, you:

  • Warrant that you are the lawful owner of the account and have the right to grant access.
  • Are responsible for enabling security features (e.g., 2FA) and backing up your data.
  • Authorize us to perform only the agreed in-game actions necessary to deliver the Service.

Warning: Many game publishers prohibit account sharing or certain in-game activities in their Terms of Use, which may result in penalties (e.g., account suspension or bans). You are solely responsible for ensuring compliance with game rules. We provide best-practice guidance (e.g., secure account settings), but cannot guarantee the absence of publisher enforcement actions. Contact [email protected] for advice on minimizing risks.

3. Ordering, Pricing & Performance

3.1 Placing Orders: Orders are placed via the Site. By confirming an order, you make a binding offer for the selected Service at the displayed price, subject to our acceptance.

3.2 Prices & Taxes: Prices are shown inclusive or exclusive of taxes, as indicated at checkout. Available currencies and payment methods are displayed during checkout. Additional fees (e.g., payment processor fees) will be disclosed where applicable. You are responsible for any applicable taxes, except where we are required to collect and remit them.

3.3 Start Time & ETA: We aim to start Services promptly after payment confirmation and receipt of necessary details (e.g., game account information). Start times and estimated times of arrival (ETAs) are estimates only and not guarantees.

3.4 Completion: A Service is deemed delivered when the agreed objective (e.g., level, achievement, raid completion) is met, as described on the product page or in the order confirmation.

4. Payments & Billing

4.1 Processors: Card payments are processed securely by Stripe; cryptocurrency payments by Plisio. We do not store full card numbers on our servers. See our Privacy Policy for details.

4.2 Chargebacks: Unauthorized chargebacks are prohibited. We may suspend accounts and pursue recovery for chargebacks made without valid grounds. If you believe a charge is incorrect, contact [email protected] before initiating a chargeback.

4.3 Taxes: You are responsible for any taxes applicable to your purchase, unless we are legally required to collect and remit them.

5. Cancellations, Refunds & Right of Withdrawal

5.1 Refunds & Cancellations: Our Refund Policy forms part of these Terms and details when you may cancel, receive a refund, or obtain credit.

5.2 EU/UK Consumers — Right of Withdrawal: If you are an EU or UK consumer purchasing Services at a distance, you may have a 14-day right of withdrawal under the EU Consumer Rights Directive or UK Consumer Contracts Regulations. Exception: The right of withdrawal does not apply after the Service has been fully performed if performance began with your express consent and acknowledgment that you lose the right of withdrawal upon full performance. We request this consent during checkout via a checkbox or similar mechanism.

5.3 Partial Performance: If you request an early start and cancel before completion, we may retain a proportionate amount for the Service already provided, as permitted by law.

6. Acceptable Use & Prohibited Activities

You agree not to:

  • Engage in cheating, exploitation, or activities violating game publishers’ terms.
  • Use the Services for unlawful purposes or to infringe third-party rights.
  • Share others’ accounts without authorization or attempt to circumvent security measures.
  • Upload or transmit malware, bots, or harmful code.
  • Interfere with the Site, Services, or our infrastructure (e.g., via DDoS attacks).

We may suspend or terminate your access if we reasonably suspect violations, with or without notice.

7. Intellectual Property & License

7.1 Our IP: All Site content, branding, and materials are owned by or licensed to ExpCarry and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Site and purchased Services for personal, non-commercial purposes.

7.2 User Content: By submitting reviews, feedback, or other content, you grant us a worldwide, royalty-free, perpetual license to use, reproduce, and display such content for marketing and service improvement, subject to our Privacy Policy.

7.3 Publisher Rights: All game titles, assets, and trademarks belong to their respective owners. No affiliation or endorsement is implied.

8. Disclaimers & No Guarantees

The Site and Services are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant:

  • Uninterrupted or error-free operation of the Site or Services.
  • That ETAs or start times will be met.
  • That game publishers will not enforce penalties (e.g., bans) for violations of their rules.

9. Limitation of Liability

To the maximum extent permitted by law, ExpCarry and its affiliates, officers, employees, or agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, goodwill, or data, arising from or related to your use of the Site or Services.

Our total aggregate liability for any claim under these Terms is limited to the greater of USD 100 or the amounts you paid to ExpCarry for the Service giving rise to the claim during the six (6) months preceding the event.

Nothing in these Terms excludes liability for fraud, willful misconduct, or any liability that cannot be limited under applicable law (e.g., consumer protections in the EU/UK).

10. Indemnification

You agree to defend, indemnify, and hold harmless ExpCarry and its personnel from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from:

  • Your breach of these Terms.
  • Your misuse of the Services or Site.
  • Your violation of game publisher rules or third-party rights.

11. Suspension & Termination

We may suspend or terminate your account or access to the Services at our discretion, with notice, if you:

  • Breach these Terms.
  • Misuse the Services or engage in fraud/abuse.
  • Create risk or legal exposure for us.

You may terminate by closing your account and discontinuing use. Sections that by their nature survive termination (e.g., IP, disclaimers, liability limits, indemnity) will remain in effect.

12. Changes to Services & Terms

We may modify the Services or these Terms at any time. Material changes will be communicated via:

  • A notice on the Site.
  • Email or on-site message.

Changes take effect when posted unless otherwise stated. Continued use of the Services after changes constitutes acceptance.

13. Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws principles. Any disputes not subject to arbitration will be resolved exclusively in the state or federal courts located in Wilmington, Delaware.

14. Dispute Resolution

All disputes arising from or related to these Terms or the Services will be resolved in the Delaware courts specified in Section 13, unless otherwise agreed in writing. We do not offer arbitration unless explicitly opted into during signup/checkout.

15. Third-Party Services

The Services may integrate or link to third-party platforms (e.g., Discord, Stripe, Plisio). We are not responsible for their content, terms, or privacy practices. Review their policies before use.

16. Compliance & Export Controls

You may not use the Services in violation of applicable sanctions, export control, or anti-money laundering laws. We may refuse, suspend, or cancel Services to comply with legal or policy requirements.

17. Force Majeure

We are not liable for delays or failures to perform due to events beyond our reasonable control, including natural disasters, wars, strikes, or technical outages.

18. User Obligations

You agree to:

  • Provide accurate and complete information when creating an account or placing orders.
  • Comply with all applicable laws and game publisher rules.
  • Cooperate with us to resolve any issues related to your use of the Services.

19. Miscellaneous

  • Entire Agreement: These Terms, together with the Privacy Policy, Refund Policy, and Cookie Policy, constitute the entire agreement between you and ExpCarry.
  • Severability: If any provision is unenforceable, the remaining provisions remain in effect.
  • No Waiver: Our failure to enforce any right or provision is not a waiver.
  • Assignment: You may not assign these Terms without our consent; we may assign them to an affiliate or successor.
  • Notices: We may provide notices via email, on-site messages, or posting on the Site.

20. Acceptance & Enforceability

We use click-to-accept mechanisms (e.g., checkbox or button) at account creation and checkout to ensure enforceability. By clicking “I agree” or similar, you acknowledge and accept these Terms.
